Well, James and D'arcy are trying to take this to a trial jury. If Virgin decides to place the blame on Billy then we may see a 1998 trio reunion in a meeting for a settlement.

Now that would be interesting to see.

To put it simply...
James and D'arcy aren't getting paid for anything downloaded off of iTunes, amazon, napster, or any other sort of digital download (which includes ringtones and streaming music). Billy's getting all of the funds. Virgin didn't bother to contact them (James and D'arcy individually have contacted Virgin to get compensated-but were pushed aside). So now they're suing because the contract they signed in 1998 says that "The Smashing Pumpkins" get payment. So far only one pumpkin has been getting payment for all digital downloads.

But like someone else asked here, why now? That stuff went online about 3 years ago, as far as the entire catalog being up on iTunes. Did they just find out?

I don't think they just found out. I think they've been trying for awhile now and nothing's happened, they're probably taking the matter into their own hands.
Plus they probably heard about the re-release of Gish. If that goes digital then they'll want a piece of that as well.

Because the lawsuit is retroactive to 1998, when Jimmy was not a member.

The contract was signed by "The Smashing Pumpkins." In 1998 "The Smashing Pumpkins" only consisted of James Iha, D'arcy, and Billy Corgan. Jimmy has no say in anything, which is actually a good thing, better off not being caught up in this mess.
